CLYMER DISTRICT COURT DOCKET

Numerous defendants have been named in criminal charges filed in the Clymer district court before Magisterial District Judge George Thachik.

Criminal complaints and affidavits of probable cause are not evidence of guilt in a criminal case. Defendants are entitled to legal representation and have the right to question the witnesses and evidence presented against during preliminary hearings in the district court and at trials in the county court of common pleas.

Charged were:

• Jared Mallory, 22, of Mallory Drive, Rossiter, charged Dec. 11 by state police with DUI and four summary driving infractions at 12:15 a.m. Nov. 9 in Chambersville.

Police responded to a report of a single-vehicle accident. Mallory had a blood alcohol content of 0.137, court papers show. Mallory waived his right to a hearing and opted to face action in Indiana County Court.

• Thomas G. Flynn Sr., 43, and Tara R. Abbotts, 38, both of Portage, Cambria County, charged Dec. 12 by state police with retail theft and conspiracy to commit retail theft at 6:09 p.m. Dec. 12 at 300 Resort Plaza Drive, Burrell Township. Abbotts was also charged with possession of drug paraphernalia.

Police responded to a report of retail theft. Walmart asset protection personnel say Abbotts and Flynn attempted to leave the store with a shopping cart containing $1,283.33 worth of merchandise.

Preliminary hearings are scheduled for Feb. 18.

• Christopher F. Neff, 32, of Patton, Cambria County, charged Dec. 26 by state police with DUI and four summary driving infractions at 9:35 p.m. Dec. 6 along Route 422, Pine Township.

Police responded to a report of a one-vehicle crash. Neff’s vehicle was stuck in snow in the front yard of a residence. Neff had a BAC greater than 0.300 percent, court papers show. Neff waived his right to a hearing and opted to face action in Indiana County Court.

• Jeremia B. Fromme, 23, of Third Street, Ernest, charged Dec. 26 by state police with DUI and three summary driving infractions at 2:47 a.m. Nov. 23 along Route 286, Cherryhill Township.

Police observed Fromme accelerate to 85 miles per hour in a 55 zone and initiated a traffic stop. Fromme had a BAC of 0.212 percent, court papers show. A preliminary hearing is scheduled for March 11.

• Dylan W. Bennett, 22, of Mahaffey, Clearfield County, charged Dec. 26 by state police with DUI and two summary driving infractions at 2:25 a.m. Nov. 23 along Route 286, Montgomery Township.

Police observed Bennett swerving over the marked lines of his lane of travel and initiated a traffic stop. Bennett had a BAC of 0.098 percent, court papers show. Bennett waived his right to a hearing and opted to face action in Indiana County Court.

• David W. Lee, 36, of Kriner Bottom Road, Rochester Mills, charged Dec. 30 by state police with DUI, unauthorized use of a motor vehicle and four summary driving infractions at 10:05 p.m. Nov. 29 along Route 286, Green Township.

Police observed a vehicle traveling with an inoperable headlight and initiated a traffic stop. Lee refused to provide a blood sample for analysis, court papers show. The vehicle’s owner claimed Lee took the vehicle without permission. A preliminary hearing is scheduled for Feb. 18.

• Edward J. Poso, 65, of Arcadia Road, Arcadia, charged Dec. 30 by state police with unauthorized use of a motor vehicle at 4:45 a.m. Nov. 30 along Johnsonburg Road, Banks Township, after a single-vehicle accident.

The vehicle’s owner claimed Poso took the vehicle without permission. A preliminary hearing is scheduled for Feb. 18.

• Jason D. Thacker, 34, of Barr Slope Road, Clymer, charged Dec. 30 by state police with DUI and four summary driving infractions at 2:12 a.m. Nov. 30 along Route 110, White Township.

Police observed Thacker’s vehicle traveling at a high rate of speed. Police say Thacker’s vehicle lost control and became stuck in snow. Thacker had a BAC of 0.168 percent, court papers show. A preliminary hearing is scheduled for March 4.

• Kenneth P. McKendrick II, 32, of Sylvan Acres Drive, Indiana, and Jackie A. Rozier, 19, of Dogwood Circle, Indiana, charged Dec. 30 by state police with theft by unlawful taking and disorderly conduct between 5 p.m. Dec. 12 and 12 a.m. Dec. 13 at Hellman Road and Route 286, White Township.

Police investigated a report of missing scrap metal worth $48.40. Rozier later sold the scrap metal at Iron Horse Salvage.

McKendrick and Rozier pleaded guilty to disorderly conduct and were ordered to pay $440.50 each in fines and costs. McKendrick’s theft by unlawful taking charge was dismissed. Rozier’s theft by unlawful taking charge was withdrawn.

CASE ADJUDICATED

Simple assault and harassment charges against Ryan J. Bressi, 23, and Brittany B. Davis, 19, both of Milton, Northumberland County, filed Dec. 13, were dismissed Feb. 4.
