Numerous defendants have been named on criminal charges filed in the Indiana and Clymer district courts.

Criminal complaints and affidavits of probable cause are not evidence of guilt in a criminal case.

Defendants are entitled to legal representation and have the right to question the witnesses and evidence presented against them during preliminary hearings in the district court and at trials in the county court of common pleas.

INDIANA

William C. Bencic, 21, of 280A Water St., Indiana, charged Aug. 31 by Indiana Borough police with two counts of DUI and one traffic violation Aug. 11 at North Third Street.

According to court dockets, Bencic has a blood alcohol content of 0.161 percent. He waived his right to a hearing and opted to face action in Indiana County Court.

Cory Richard Reilly, 20, of 1820 Moore Ave., North Apollo, charged Aug. 31 by Indiana Borough police for resisting arrest, two counts of disorderly conduct, escape, public drunkenness and underage drinking. The charges were held for court.

Sandra Ellen Medsger, 56, of 350 Gompers Ave, Indiana, charged Aug. 31 by Indiana Borough police for giving unsworn falsification to authorities at 3:20 p.m. July 25 at 80 N. Eighth St., Indiana. Medsger waived her right to a preliminary hearing and opted to face action in Indiana County Court.

Michael Kenneth Edgar, 53, no permanent address, charged Sept. 1 by Indiana Borough police with two counts of indecent assault and two counts of corruption of minors at 477 Oak St., Indiana, July 16. The case was held for court.

Tony Eppolito, 24, of, Johnstown, charged Sept. 1 by Indiana Borough police with public drunkenness, criminal mischief, loitering and prowling at night and disorderly conduct at 320 S. Coulter Ave. At a preliminary hearing held Dec. 15, he pleaded guilty to public drunkenness, criminal mischief and disorderly conduct.

According to court dockets, loitering and prowling charges were withdrawn.

Luke Remaley Nelson, 18, of, Natrona Heights, Allegheny County, charged Sept. 2 by Indiana Borough police with possession of a small amount of marijuana, possession of drug paraphernalia, underage drinking and public drunkenness after officers found him at 12:11 a.m. Sept. 2 lying face down in the grass along Papermill Avenue near Philadelphia Street.

Court papers show that Nelson pleaded guilty to possession of a small amount of marijuana and public drunkenness at a Nov. 17 preliminary hearing.

According to dockets, underage drinking and possession of drug paraphernalia charges were withdrawn.

Davon Maurice Loveings, 20, of Pittsburgh, charged Sept. 2 by Indiana Borough police for possession of marijuana and operating a vehicle while operating privilege is suspended or revoked on Aug. 27 at Papermill Avenue.

According to court dockets, Loveings pleaded guilty to possession of marijuana and operating a vehicle while privilege is suspended or revoked at a preliminary hearing held Dec. 28.

Anthony Wadde Carter, 20, and Asa Christian Thomas, 20, both of Beaver Falls, were charged Sept. 6 by Indiana Borough police following a traffic stop Sept. 3 at 1500 Philadelphia St.

Carter pleaded guilty to disorderly conduct at a preliminary hearing held Jan. 19.

According to court dockets, Thomas opted to waive his right to a preliminary hearing to face action in county courts with three counts of manufacture, delivery or possession of an adulterated substance, three counts of possession of a controlled substance, two counts of possession of drug paraphernalia and two summary traffic violations.

Bjorn Twyman, 26, of McKees Rocks, charged Sept. 8 by Indiana Borough police with manufacture, delivery or possession of an adulterated substance, small amount of marijuana, possession of drug paraphernalia and criminal use of communication facility. According to court papers, the case was held for court.

CLYMER

Steven David Williams, 22, of Marsteller, charged Feb. 22 by state police with DUI and several traffic offenses Feb. 16 on Route 286 near Cush Creek Road in Montgomery Township. The alcohol concentration of his breath was 0.176 percent, court records show. A preliminary hearing was set for March 27.

Boyd Murray Watson Jr., 45, of Shelocta, charged Feb. 22 by state police with DUI, resisting arrest and four traffic offenses Feb. 22 on Davis Road near Five Points Road. His blood alcohol level was not reported. A preliminary hearing was set for March 27.

Barbara Hughes, 41, of Indiana, charged Feb. 24 by REA Energy with writing a bad check worth $630 Dec. 14. A preliminary hearing was set for April 3.

Robert I. Fisher, of Indiana, charged Feb. 24 by Kevin J. Latimer Jr. with writing a bad check worth $1,235.91 Aug. 29. A preliminary hearing was set for April 3.

Coral Rae Castellar, 30, of Clymer, charged Feb. 28 by state police with DUI and three traffic offenses Feb. 2 on Route 286 near Fyock Road. Police said she was under the influence of drugs. A preliminary hearing was set for March 27.

David Paul Holbein, 25, of Rural Valley, charged Feb. 28 by state police in Kittanning with possession for sale or use of display documents May 2.

A preliminary hearing was set for April 10.

Kayla Sue Noon, 25, of New Florence, charged Feb. 29 by state police with a felony count of possession of a controlled or contraband substance and misdemeanor counts of possession of a controlled substance, possession of a contraband/non-controlled substance and possession of drug paraphernalia May 25.

A preliminary hearing has not been set.

Christine Thibadeau Smatlak, 31, of Creekside, charged March 1 by state police with felony counts of theft, theft by deception, receiving stolen property, theft by failure to make required disposition of funds, and use of an access device issued to another without permission Feb. 16. Bail was set at $100,000. A preliminary hearing was set for March 20.

Magdalene Ann Volk, 23, of Blairsville, charged March 7 by state police with simple assault and harassment Oct. 9 at the Indiana County Jail.

A preliminary hearing was set for April 10.

Eric Matthew Miller, 37, of Strongstown, charged March 9 by state police with DUI and several traffic offenses March 7 on Route 553 in Pine Township. The alcohol concentration of his breath was 0.186 percent, court records show. A preliminary hearing has not been set.
