Numerous defendants have been named in criminal charges filed in the Indiana district court before Magisterial District Judge Guy Haberl.

Criminal complaints and affidavits of probable cause are not evidence of guilt in a criminal case.

Defendants are entitled to legal representation and have the right to question the witnesses and evidence presented against them during preliminary hearings in the district court and at trials in the county court of common pleas.

Charged were:

Aaron Griffith, 24, of North Versailles, Allegheny County, and Nathan Shelton, 21, of Pittsburgh, Allegheny County, charged Jan. 4 by IUP police with possession of a small amount of marijuana at 1:41 a.m. Dec. 1 at 1149 Oakland Ave.

Police observed Griffith parked in a reserved space in the IUP parking garage and detected the smell of marijuana when advising Griffith that he couldn’t park there.

Griffith was also charged with possession of drug paraphernalia.

Prosecutors withdrew the paraphernalia charge against Griffith, and he pleaded guilty to possession of marijuana and was fined.

Prosecutors withdrew the possession of marijuana change against Shelton, and he pleaded guilty to disorderly conduct and was also fined.

Ashley Gunnett, 20, of Altoona, Blair County, charged Jan. 4 by IUP police with DUI, underage drinking and a summary driving offense at 1:59 a.m. Dec. 9 in the Keith Hall parking lot.

Police responded to a report of an intoxicated female attempting to drive. Gunnett had a blood alcohol content of 0.174 percent, court papers show.

Gunnett waived her right to a hearing and opted to face action in Indiana County Court.

Jasmine Grier, 21, of Philadelphia, charged Jan. 4 by IUP police with DUI and three summary driving offenses at 2:05 a.m. Oct. 20 in the 1000 block of Oakland Avenue, following a traffic stop for making a right turn at a red light with a sign indicating right turns on red were not permitted. Grier had a BAC of 0.14 percent, court papers show.

The case was held for court.

Stephen Joseph Yargeau, 20, of Latrobe, Westmoreland County, charged Jan. 4 by IUP police with DUI, underage drinking and three summary driving offenses following a traffic stop at 1:42 a.m. Oct. 17 at the intersection of Oakland Avenue and School Street.

Yargeau’s vehicle was stopped in the middle of Oakland Avenue without headlights or hazard lights illuminated. Yargeau had a BAC of 0.11 percent, court papers show.

Yargeau waived his right to a hearing and opted to face action in Indiana County Court on the charges of DUI, underage drinking and one summary driving offense. The remaining summary driving offenses were withdrawn.

Warren Williams, 20, of West Grove, Chester County, charged Jan. 4 by IUP police with DUI, underage drinking and three summary driving infractions at 12:39 a.m. Nov. 2 in the 900 block of Oakland Avenue, following a traffic stop for crossing over the double-yellow line. A preliminary hearing is scheduled for Wednesday.

Shayne Reimold, 19, of Greenville, Mercer County, charged Jan. 7 by Indiana Borough police with DUI, underage drinking and three summary driving infractions at 9:28 p.m. Nov. 10 in the 700 block of Washington Street, following a traffic stop for not coming to a complete stop at a posted stop sign.

Reimold had a BAC of 0.094 percent, court papers show.

Reimold waived his right to a hearing and opted to face action in Indiana County Court on the DUI charge and two summary driving infractions.

The underage drinking charge and one summary driving infraction were withdrawn.

Allen Lane, 47, of Roush Drive, Indiana, charged Jan. 10 by state police with possession with intent to deliver a controlled substance, possession of a controlled substance and possession of drug paraphernalia at 12:20 p.m. Feb. 24, 2011, at 136 Roush Drive.

Lane sold 3 grams of cocaine to a confidential informant for $300.

Lane waived his right to a hearing and opted to face action in Indiana County Court.

Weylin Fratzke, 18, of Church Street, Indiana, charged Jan. 14 by IUP police with criminal trespass, theft by unlawful taking, receiving stolen property and burglary at 11:30 a.m. Jan. 14 at 660 S. 11th St.

Officers received a report of a stolen iPhone 4S from the Memorial Field House. Later, the suspect was seen at the Wayne Avenue McDonald’s, where officers found him in possession of the iPhone. Fratzke was not permitted inside the field house due to prior incidents.

Fratzke waived his right to a hearing and opted to face action in Indiana County Court.

Eric Hardaway, 21, of South Seventh Street, Indiana, charged Jan. 11 by Indiana Borough police with possession of a small amount of marijuana at 1:19 a.m. Jan. 11 in the 400 block of North Fourth Street. Hardaway approached officers making a traffic stop, claiming to be lost.

While speaking with officers, Hardaway removed a clear plastic bag from his pocket containing marijuana.

Hardaway pleaded guilty to possession of a small amount of marijuana and was ordered to pay $662 in fines and costs.

Craig Stuck, 46, of Maple Street, Indiana, and Brian Pavolik, 45, of Grandview Avenue, Indiana, charged Jan. 11 by Indiana Borough police with possession of a small amount of marijuana at 4:50 p.m. Dec. 16 in the 600 block of Maple Street, following a traffic stop for an inoperable brake light. Stuck was also charged with DUI and a summary driving offense. Stuck had a BAC of 0.163 percent, court papers show.

Stuck waived his right to a hearing and opted to face action in Indiana County Court on the DUI charge and the summary driving infraction. His marijuana possession charge was withdrawn.

Pavolik pleaded guilty to possession of a small amount of marijuana and was ordered to pay $662 in fines and costs.

Cases Adjudicated

Charges of simple assault, criminal mischief and disorderly conduct against Jessica Bottenhorn, 31, of Creekside, filed Jan. 7, were dismissed Feb. 13.

Charges of simple assault and harassment against Rocky Kromer, 42, and Adrienne Gibson, 34, both of Indiana, filed Jan. 14, were withdrawn Jan. 24.
