Numerous defendants have been named in criminal charges filed in the Indiana district court before Magisterial District Judge Guy Haberl.

Criminal complaints and affidavits of probable cause are not evidence of guilt in a criminal case. Defendants are entitled to legal representation and have the right to question the witnesses and evidence presented against them during preliminary hearings in the district court and at trials in the county court of common pleas.

Charged are:

Rashawn Henry, 20, of Philadelphia, charged Feb. 20 by Indiana Borough police with possession of a small amount of marijuana, possession of drug paraphernalia and providing false identification to a law enforcement officer at 1:12 a.m. Feb. 12 at 1300 Oakland Ave.

Officers responded to a report of a loud party and reported smelling marijuana when the door was opened. Henry provided a false name to officers when asked for identification.

Henry waived his right to a hearing and opted to face action in Indiana County Court.

Jason Broadbent, 28, of Philadelphia Street, Indiana; and Derek Myers, 26, of Saint Clair Street, Homer City, charged Feb. 21 by Indiana Borough police with possession of a controlled substance and drug paraphernalia at 7:08 p.m. Dec. 21 in the 200 block of Washington Street. Police were patrolling the area following a report of drug activity and observed Myers make a right turn without signaling. Myers was also charged with DUI.

Broadbent and Myers waived their right to a hearing and opted to face action in Indiana County Court.

Donte Boykin, 24, of Philadelphia Street, Indiana, charged Feb. 20 by Indiana Borough police with terroristic threats, recklessly endangering another person, criminal mischief and disorderly conduct at 1:44 a.m. Feb. 16 in the 100 block of Wherle Way.

Officers responded to a report of a male threatening a tow truck driver.

Boykin had parked in a private lot and returned to his vehicle as it was about to be towed.

Boykin waived his right to a hearing and opted to face action in Indiana County Court.

Christian Newsome, 22, of Philadelphia, charged Feb. 26 by Indiana Borough police with simple assault, disorderly conduct and harassment at 12:55 a.m. Feb. 6 in the 600 block of Philadelphia Street. Police responded to a 911 hang-up call and found a dazed male who had been struck on the head.

Newsome waived his right to a hearing and opted to face action in Indiana County Court.

Brett Tyson, 24, of Pittsburgh, charged March 4 by Indiana Borough police with possession of a small amount of marijuana, possession of drug paraphernalia and disorderly conduct at 9:59 p.m. Oct. 16 at 933 Wayne Ave. Officers responded to a report of drug activity and followed up with the residents.

Tyson pleaded guilty to disorderly conduct and was ordered to pay $250.50 in fines and costs. His remaining charges were withdrawn.

Brandon Gochenauer-Jerue, 28, of Hillside Drive, Clymer, charged March 6 by Indiana Borough police with DUI, aggravated assault by vehicle while DUI, possession of a small amount of marijuana, possession of drug paraphernalia, simple assault and three summary driving offenses at 7:59 p.m. Oct. 12 in the 1300 block of Philadelphia Street. Police responded to a vehicle accident and detected the smell of marijuana in Gochenauer-Jerue.

Gochenauer-Jerue waived his right to a hearing and opted to face action in Indiana County Court.

Bobbi Dehner, 37, of Punxsutawney, Jefferson County, charged March 7 by Delaney Chevrolet Inc. with issuing a bad check for $1,500 Nov. 29 at 626 Water St.

Dehner waived her right to a hearing and opted to face action in Indiana County Court.

Cases Adjudicated

Charges of counterfeit documents and violations concerning licenses against David Palmer, of Greensburg, filed Feb. 26, were withdrawn April 10.

Charges of possession of a small amount of marijuana and drug paraphernalia against Michael Melendez, of Bainridge, and Daniel Zovich, of Elmhurst, N.Y., filed March 4, were withdrawn March 27.
