Numerous defendants have been named in criminal charges filed before Magisterial District Judge Guy Haberl, of Indiana.

Criminal complaints and affidavits of probable cause are not evidence of guilt in a criminal case. Defendants are entitled to legal representation and have the right to question the witnesses and evidence presented against them during preliminary hearings in the district court and at trials in the county court of common pleas.

• Tony R. Grady, 25, of Newark, N.Y., charged Nov. 5 by Indiana Borough police with possession of a small amount of marijuana at 1 a.m. Nov. 1 in the 500 block of Philadelphia Street. During a traffic stop in which Grady was a passenger, police observed a small bag of marijuana between Grady’s feet. A preliminary hearing is scheduled for Jan. 29.

• Bryant O. Lyons, 21, of Philadelphia, charged Nov. 5 by Indiana Borough police with retail theft, disorderly conduct and resisting arrest at 2:46 a.m. Nov. 2 at 435 S. Seventh St. An officer on security detail at Giant Eagle Express was advised that a male had left the store without paying for a food item. Lyons actively resisted during the arrest. A preliminary hearing is scheduled for Jan. 29.

• Derek A. DeSalvo, 19, of Belle Vernon, Fayette County, charged Nov. 5 by Indiana Borough police with resisting arrest, simple assault, disorderly conduct, harassment, public drunkenness, underage drinking and criminal mischief at 2:40 a.m. Nov. 2 in the 900 block of Wayne Avenue.

An officer observed DeSalvo tackle and physically assault another male in a front yard on Wayne Avenue. DeSalvo didn’t comply with orders to stop and actively resisted during the arrest. A preliminary hearing is scheduled for Thursday.

• Austin States, 19, of Starford Road, Clymer, charged Nov. 5 by Indiana Borough police with DUI, possession of a small amount of marijuana, possession of drug paraphernalia, possession of an offensive weapon and three summary driving infractions at 12:49 a.m. July 7 in the 400 block of School Street.

Officers observed that States did not stop at a posted sign and initiated a traffic stop. Officers detected the smell of marijuana and alcohol in the vehicle. States had a blood alcohol content of 0.113 percent, court papers show. During a search, marijuana, drug paraphernalia and brass knuckles were found. A preliminary hearing is scheduled for Thursday.

• Alexis T. Martin, 21, of Locust Street, Indiana; Olivia Robinson, 22, of Philadelphia; and Nicolette Burton, 21, of Locust Street, Indiana, charged Nov. 5 by Indiana Borough police with obstructing administration of law, resisting arrest, disorderly conduct and criminal mischief at 2:34 a.m. Oct. 25 in the 1300 block of Locust Street.

Officers responded to a report of a domestic disturbance. Martin, Robinson and Burton had verbally and physically confronted a male who had arrived to pick up his girlfriend. When officers attempted to question the girlfriend, Martin, Robinson and Burton tried to prevent them from approaching her.

Preliminary hearings for the three are scheduled for Jan. 30.
