Students waive riot hearings

ALTOONA (AP) — Eight of 12 students arrested and charged with rioting at a Penn State satellite campus apartment building have waived preliminary hearings in hopes of having rioting charges dismissed in favor of a probation-without-verdict program that will enable their records to be expunged.

The attorney for one man, Kevin Nelson, 19, alleges his client was just sitting on a porch and was wrongly accosted by police. He intends to fight the charges and investigate whether police used excessive force.

But three other Penn State-Altoona students arrested April 6 are expected to try to resolve their charges, too, but had their Thursday hearings postponed.

Logan Township police say about 800 people were drinking and dancing outside the Nittany Pointe apartments when police declared it a riot after liquor bottles were thrown at a police car.
